Abstract

Sexual violence against children is a serious human rights violation that has a destructive impact on children's future. To address this, the global criminal law paradigm has shifted toward a modern, victim-oriented victimology, which places victim recovery as a top priority, equal to punishment for the perpetrator. In Indonesia, this principle is accommodated through Article 59A of Law No. 35 of 2014 concerning Child Protection and Law No. 12 of 2022 concerning Criminal Acts of Sexual Violence (UU TPKS), which explicitly guarantee victims' rights to treatment, protection, and recovery (restitution and rehabilitation). However, the realization of these rights in the criminal justice system still faces various legal and practical obstacles. Therefore, this normative legal research using statutory, conceptual, and case-based approaches aims to analyze the actual implementation of legal protection for child victims of sexual violence as a manifestation of the application of the principles of modern victimology
